1. Agreement to Terms

By accessing or using the cheese mobile application (the "Service") operated by sabko.shop ("we," "us," or "our"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

2. Service Description

The Service provides a platform for capturing photographs, organizing them into collections of ten photographs ("reels"), and ordering physical prints of such reels for delivery to a designated address.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

- Provide accurate, current, and complete information during registration

- Maintain and promptly update your account information

- Maintain the security and confidentiality of your account credentials

- Accept responsibility for all activities that occur under your account

5. User Content and Intellectual Property

5.1 Ownership:

You retain all ownership rights in photographs you capture using the Service.

5.2 License Grant:

By using the Service, you grant sabko.shop a limited, non-exclusive, royalty-free license to use, reproduce, process, and print your photographs solely for the purpose of fulfilling your print orders and providing the Service.

5.3 User Warranties:

You represent and warrant that:

- You own or have obtained all necessary rights, licenses, and permissions to capture, upload, and print the photographs

- Your photographs do not infringe upon the intellectual property, privacy, or other rights of any third party

- Your photographs comply with all applicable laws and regulations

5.4 Prohibited Content:

You may not use the Service to capture, upload, or print content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

6. Print Orders

6.1 Order Process:

Print orders are processed upon receipt of payment. Once an order is placed and payment is confirmed, the order cannot be cancelled.

6.2 Order Refusal:

We reserve the right to refuse, cancel, or limit any order at our sole discretion, including orders that violate these Terms or our content policy.

6.3 Delivery:

Delivery times are estimates only. We are not responsible for delays caused by shipping carriers, weather conditions, or other factors beyond our reasonable control.

6.4 Print Quality:

While we strive for high-quality prints, variations may occur due to the nature of the printing process. We are not liable for minor variations in color, size, or quality that are within industry standards.

7. Payment Terms

7.1 Pricing:

All prices are displayed in the currency shown at checkout and are subject to change without notice. Pricing is based on a per-photo basis for capturing photographs through the Service.

7.2 Payment:

Payment is required in advance for each photograph you capture using the Service. Each photo capture incurs a charge, which must be paid before the photo is saved to your reel. Payment for printing services is separate and required when you place a print order for a completed reel. We accept payment through designated third-party payment processors.

7.3 Refunds:

Refunds for photo captures are not available once a photo has been captured and saved. Refunds for print orders are available only for orders that have not yet entered the printing process, subject to our refund policy.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SABKO.SHOP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Indemnification

You agree to indemnify, defend, and hold harmless sabko.shop and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or relating to your use of the Service or violation of these Terms.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause or notice, for any reason, including violation of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Kannur, Kerala, India.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes acceptance of the modified Terms.
